Terms of Service

1. Service description

Komments is a hosted commenting platform that allows website owners ("Owners") to embed a commenting widget on their sites, and allows end users ("Commenters") to post comments on those sites. The Service is provided by Utilities Studio / Hariom Sharma ("Komments", "we", "us").

By creating an account or using the Service in any capacity, you agree to be bound by these Terms. If you are accepting on behalf of a company, you represent that you have authority to bind that company.

2. Account responsibilities

You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Ensuring that your use of the Service complies with applicable laws
• Promptly notifying us of any unauthorized access to your account

You may not share your account credentials or allow others to access your account. Each user must have their own account.

3. Acceptable use

You may not use the Service to:

• Post spam, unsolicited commercial messages, or automated bot content
• Upload illegal content, including content that infringes copyright, defames individuals, or violates privacy
• Harass, threaten, or abuse other users
• Distribute malware, phishing links, or other malicious code
• Circumvent or disable AI moderation systems
• Scrape or extract data from the Service in ways not permitted by the API terms
• Resell or sublicense the Service without prior written agreement

We reserve the right to suspend or terminate accounts that violate these rules, without notice.

4. Pricing and billing

Paid plans are billed monthly in advance. Billing is handled by Stripe. By providing a payment method, you authorize us to charge it for the applicable plan fees.

Subscriptions auto-renew unless cancelled before the next billing cycle. Cancellations take effect at the end of the current billing period -- you retain access until then. We do not offer prorated refunds for partial months.

We reserve the right to change pricing. We will give at least 30 days notice of price increases by email. Continued use after a price change constitutes acceptance of the new pricing.

5. Content ownership

Commenters retain full ownership of the content they post. By posting a comment, you grant Komments a non-exclusive, royalty-free licence to store, display, and transmit that content as necessary to operate the Service.

Site Owners retain ownership of their site configuration, custom themes, and moderation settings. You may export all your data at any time.

Komments does not claim ownership of any user-generated content.

6. Service availability

We strive for high availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance, Cloudflare infrastructure incidents, or unforeseen outages may cause temporary unavailability. We are not liable for losses arising from Service downtime.

7. Limitation of liability

To the maximum extent permitted by law, Komments and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages -- including loss of profits, data, or goodwill -- arising from your use of or inability to use the Service.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Komments, its operators, and affiliates from any claims, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

9. Termination

You may delete your account at any time from the admin dashboard. We may suspend or terminate your account at any time for violation of these Terms.

Upon termination, your access to the Service will cease and your data will be deleted within 30 days, subject to retention obligations described in the Privacy Policy.

10. Changes to these Terms

We may revise these Terms at any time. Material changes will be communicated by email or in-app notice with at least 14 days advance notice. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms shall be resolved in the courts of the UAE, and you consent to the personal jurisdiction of those courts.
